Chapter 5 - The Emergency Hearing

Vanessa did not sit beside Luca at the hearing.

That mattered.

She sat with her new attorney, Aisha Grant, a family-law specialist with no connection to Moretti or Vale.

Adrian sat across with his attorney.

Luca sat in the back row because the judge permitted him as relevant prospective household member? But engagement ended now. He actually did not need to attend. Let's make he attended only for a limited witness issue because his trust draft was evidence. Yes.

Luca was there because Adrian’s petition relied on Luca’s trust.

Not because he was Nico’s parent.

Good.

Elena sat near Vanessa.

Nico did not attend.

Also good.

No six-year-old in courtroom if unnecessary.

The hearing was narrow.

Adrian wanted temporary restrictions preventing Vanessa from:

moving Nico into a Moretti residence,

changing his school,

changing his surname,

designating him under a Moretti trust,

or altering guardianship arrangement without court approval.

Vanessa’s lawyer did not oppose most.

Why?

Because she had no current plan to do those things.

The wedding was canceled.

She agreed no move.

No school change.

No surname change.

No trust designation.

Adrian looked surprised.

His emergency became smaller.

Then guardianship.

Elena’s court-approved guardianship was due for annual review in two months.

Adrian wanted Nico moved to him instead.

Grounds:

Vanessa’s concealment.

Her attempt to plan financially around Moretti marriage.

Her instability? Careful. He called poor judgment, not health speculation.

Her use of third-party guardian despite being available.

Vanessa’s lawyer answered.

The guardianship had been agreed by Adrian three years earlier after stalking concerns and both parents’ work schedules.

He had signed.

Elena provided stable home.

Nico thriving.

No evidence Vanessa intended to remove Nico secretly.

She had researched trust consequences, yes.

Bad judgment maybe.

Not abduction.

Then the leaked trust draft.

Judge asked Adrian’s attorney:

“How did your client obtain this?”

Counsel disclosed unauthorized family chain and said he had since notified court.

Judge was unhappy.

The exhibit was not treated as proof of a final plan.

Then Daniel Kline testified briefly.

Vanessa asked questions about how marriage might affect estate planning.

He told her no child would become beneficiary automatically.

Any designation would require Luca’s written act.

Vanessa asked about dependent-child definitions.

She did not ask how to seize control or transfer money.

Important.

So her action was boundary violation with Luca, not proof of scheme against Nico’s father.

Then Luca.

Adrian’s attorney asked:

“Did Ms. Bellini discuss making Nico a beneficiary of your trust?”

“No.”

“Did you know Nico existed?”

“No.”

That looked terrible for Vanessa.

Then:

“Would you have considered adding him?”

“I don’t know.”

“Were you planning to adopt him?”

“No.”

“Did Ms. Bellini suggest that?”

“No.”

Then Vanessa’s attorney asked:

“Did Ms. Bellini have authority to add Nico herself?”

“No.”

“Could marriage alone make Nico a beneficiary?”

“No.”

“Is the draft relied upon by Mr. Vale final?”

“No.”

“Signed?”

“No.”

“Was it leaked without your permission?”

“Yes.”

Good.

Judge now had accurate scope.

Then Adrian testified.

He loved his son.

No one disputed.

He resented Elena guardianship.

He had agreed because he was traveling and because surveillance incident frightened everyone.

He now wanted primary residence.

Why now?

“Because Vanessa is marrying Luca Moretti.”

Aisha said:

“She isn’t.”

Adrian looked toward Luca.

News to him?

Maybe he knew engagement canceled through media? Not yet private.

Judge asked.

Vanessa:

“The engagement ended.”

Adrian’s face changed.

Then why emergency?

The basis shifted.

He still argued her lying showed poor judgment.

Judge asked:

“Did she lie to you about Nico’s location?”

“No.”

“Did she interfere with your parenting time?”

“No.”

“Did she deny you contact?”

“No.”

“Did she move him?”

“No.”

“Did she attempt trust designation?”

“No.”

Then emergency removal not justified.

The court maintained existing guardianship pending normal review.

Added temporary order:

No material residence/school changes without notice.

No third-party trust designation in Nico’s name without disclosure to both parents and guardian? Can a parent stop gifts? Court may not need. Better just no legal-status changes related to guardianship without court.

No need overreach.

Then judge addressed both parents.

“A child is not a treaty between families.”

That line.

Neither Moretti nor Vale.

Just Nico.

Then:

“Stop litigating surnames you think he represents and start litigating actual welfare if there is a real dispute.”

Strong.

Then private investigators.

Judge criticized nighttime surveillance near child.

Adrian agreed to restrict surveillance from school/home absent specific legal need.

Not blanket maybe.

Then Vanessa.

Judge criticized concealment from fiancé? Not court issue.

Maybe said:

“Your private relationship choices are not custody findings unless they affect child.”

Good.

No moralizing.

Hearing ended.

No winner exactly.

Existing stable arrangement remained.

Then hallway.

Adrian approached Vanessa.

Roman was there for Luca but kept distance.

Adrian said:

“You embarrassed me.”

Vanessa laughed.

“You filed my son into your pride.”

“Your son?”

“Our son.”

Good correction.

Then:

“You were going to make him a Moretti.”

“No.”

“You were going to marry one.”

“That is not same.”

Adrian looked at Luca.

“You believe her?”

Luca said:

“This isn’t my argument.”

Good.

Then Adrian:

“Your father would have understood.”

Luca’s eyes narrowed.

“Don’t use my father to talk about a six-year-old.”

Adrian left.

No fistfight.

Then Vanessa sat on courthouse bench.

Aisha beside.

She looked at Luca.

“Thank you for testifying.”

“I testified because my document was used.”

“I know.”

No romance.

Then:

“Nico asked about you again.”

Luca rubbed forehead.

“What did you tell him?”

“That you and I aren’t getting married.”

“How did he take it?”

“He asked if it was because of him.”

Luca closed eyes.

That was exactly what he feared.

Then Aisha said:

“You do not owe the child a relationship.”

Correct.

Vanessa nodded.

“I know.”

Then Luca asked:

“Does he have a therapist?”

“Yes.”

“Ask her what is least confusing.”

Good.

Not adult instinct.

Professional.

Then Sal.

At mansion, he had resumed driving.

But something had changed.

He insisted on formal schedule.

No more “Vanessa said Luca wants.”

If Luca wanted Wisconsin, Luca told him.

Direct.

Luca found it almost insulting.

Then realized.

Good.

At 6:30 the next morning, he entered garage.

Sal was polishing sedan.

“You have five minutes?”

Sal looked at watch.

“For you, four.”

Luca smiled.

Then gave him birthday card.

Still sealed.

“You want me to open?”

“No. It’s yours.”

Luca opened.

Inside:

Kid,

You don’t need another expensive thing from me. I just want one more October road before my knees decide otherwise.

Happy birthday.

Sal.

Luca stared.

Then:

“You thought I didn’t want this.”

Sal shrugged.

“I thought you were busy.”

“No.”

“I know now.”

Luca looked at him.

“Why didn’t you ask?”

Sal stopped polishing.

“You weren’t asking me much either.”

Fair.

Then:

“Wisconsin still on?”

“Yes.”

“Good.”

Then Sal handed him the red mitten.

“What do I do with this?”

“Give it back to the kid.”

“When?”

“That’s your problem.”

Then he resumed polishing.

Luca held the mitten.

A child’s object had exposed:

a hidden son,

a broken engagement,

a lawyer conflict,

a trust leak,

and thirty-four years of friendship strained by delegation.

But it still belonged to a six-year-old.

That was the simplest truth.

Then Emma entered garage with coffee for Sal.

She saw mitten in Luca’s hand.

“Still have it.”

“Yes.”

“Nico wants it.”

Luca looked.

“How do you know?”

“Vanessa asked kitchen if anyone found it.”

He nodded.

Then Emma hesitated.

“Can I say something?”

“Apparently everyone can now.”

She almost smiled.

“Don’t give it back like it’s evidence.”

Luca looked down.

“What do you mean?”

“It’s a mitten.”

Exactly.

He asked Vanessa’s lawyer to arrange return through Elena.

No meeting.

No gesture.

No symbolism.

Just a child getting his mitten back.

Two days later, Nico sent a drawing.

Red crayon car.

Small figure labeled SAL.

Another figure labeled MOM.

A black car with a man beside it labeled LUCA? Not yet if never met. Maybe he drew "MITTEN MAN"? Let's avoid.

He sent a note:

THANK YOU FOR MY GLOVE.

Luca stared at the childish block letters.

Not son.

Not beneficiary.

Not Vale.

Not Moretti.

A child who wanted his glove.

Then Roman entered with another file.

The audit of Paolo’s communications was complete.

Paolo had leaked no other documents.

Lucia had forwarded only the trust draft.

No paid connection to Adrian.

No long conspiracy.

Good.

But Daniel Kline’s office had another problem.

Someone had accessed Vanessa’s custody consultation notes Tuesday night after Daniel left the mansion.

Not Paolo.

Not Lucia.

User account:

Rachel Dunn.

The family lawyer who later claimed she had not formally represented Vanessa.

And the access occurred twenty minutes before Adrian arrived at Rachel’s office.

Vanessa’s custody petition problem had not come only from family gossip.

Someone on the legal side had been opening her confidential file at exactly the wrong time.

Before leaving court, Aisha made Vanessa sign one practical instruction for herself.

No more direct contact with Adrian about litigation.

Parenting logistics through the approved co-parenting channel.

Legal disputes through lawyers.

Emergency child issues by phone.

Vanessa looked offended.

“We’ve managed for years.”

Aisha raised eyebrow.

“You are in an emergency hearing caused partly by unmanaged communication.”

Vanessa signed.

Structure was not punishment.

Sometimes it was how adults stopped turning every emotional reaction into evidence.
